1. Who We Are

Coomerang is operated by Coomerang LTD, a private limited company registered in England and Wales under company number 16557189, with registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

These Terms apply to your use of the Coomerang website, editor, APIs, community features, subscriptions, AI image features, and related services.

2. Acceptance

By accessing or using Coomerang, you agree to these Terms, our Privacy Policy, our Cookies Policy, and our Copyright Policy.

If you do not agree, do not use the service. If you use Coomerang on behalf of a business or other organisation, you confirm that you have authority to bind that organisation.

3. Accounts and Eligibility

• You must provide accurate account information and keep your credentials secure.
• Email verification may be required for account features, publishing, password recovery, and mature-content settings.
• You are responsible for activity on your account unless it results from our breach of these Terms or applicable law.
• You must not share, sell, rent, or transfer your account without our permission.
• You must not try to bypass age verification, content filters, security controls, usage limits, or subscription restrictions.

4. Service Features

Coomerang lets users create, edit, save, publish, and discover digital comics. Features may include uploads of images and videos, comic pages, panels, text, quizzes, public profiles, likes, views, reports, subscriptions, and AI-assisted image generation or editing.

Some features require login, email verification, age verification, subscription access, or AI image credits. We may change, suspend, or discontinue features where needed for technical, legal, safety, or business reasons.

5. Mature Content and Age Assurance

Coomerang hides mature-labelled content by default. Users who are 18 or older may request access to mature content by completing age verification through a third-party provider such as Didit and enabling the relevant setting in their account.

• Users under 18, unverified users, and users who disable the setting cannot access mature-labelled content through normal platform features.
• We may require re-verification, disable mature-content access, or remove access where verification fails, expires, appears unreliable, or is required by law or safety policy.
• Creators must accurately label mature material and must not make mature content available to minors or outside the intended access controls.
• Automated and human moderation can make mistakes. An absent flag does not mean content is permitted, and a flag may be reviewed or corrected.

6. User Content

You retain the rights you have in comics, images, videos, prompts, text, profile information, and other material you submit to Coomerang.

By submitting User Content, you grant Coomerang a worldwide, non-exclusive, royalty-free licence to host, store, cache, reproduce, display, distribute, transmit, resize, convert, analyse, moderate, and create technical derivatives of that content for the purposes of operating, protecting, improving, and promoting the service.

You confirm that you have all rights, permissions, and consents needed for your User Content and that your content does not violate these Terms, applicable law, or anyone else's rights.

7. Content Rules

You must not upload, publish, generate, share, or attempt to distribute content that is illegal, harmful, abusive, misleading, or otherwise prohibited by these Terms.

• Child sexual abuse material, grooming, sexual content involving minors, or sexual content involving age-ambiguous characters is strictly prohibited, including where fictional, illustrated, AI-generated, or stylised.
• Non-consensual intimate content, intimate image abuse, sexual extortion, revenge pornography, or deepfake sexual content without clear consent is prohibited.
• Terrorism, violent extremism, credible threats, instructions for violence, illegal weapons sales, illegal drug sales, scams, fraud, malware, phishing, or evasion of law enforcement is prohibited.
• Harassment, bullying, stalking, hateful conduct, incitement to hatred or violence, and targeted abuse are prohibited.
• Content that promotes, encourages, or instructs suicide, self-harm, eating disorders, or dangerous activities is prohibited.
• Copyright infringement, trademark infringement, impersonation, or misuse of another person's identity, likeness, or confidential information is prohibited.
• Lawful mature content may only appear where accurately labelled and kept behind the mature-content controls.

8. Moderation, Reports, and Appeals

We use a combination of user reports, automated safety signals, third-party moderation tools, and human review to help enforce these Terms. This may include Google Cloud Vision SafeSearch for uploaded images and sampled video frames.

Depending on the context, we may take no action, label content as mature, queue content for review, unpublish or remove content, restrict features, hide profile information, suspend or deactivate accounts, preserve evidence, or report matters to relevant authorities where required or appropriate.

• You can report comics, profiles, or other issues using in-product report tools, the Contact page, or [email protected].
• Where practical and appropriate, we may notify affected users of moderation decisions and provide a reason.
• You may appeal a moderation or account decision by contacting us with relevant context and the affected URL or account details.
• We may prioritise urgent safety, child protection, illegal content, or security issues over other reports.

Where the UK Online Safety Act, the EU Digital Services Act, or similar laws apply, these Terms are intended to explain our rules, reporting routes, and moderation approach in a clear and accessible way. References to legal regimes are for transparency and are not legal advice.

9. Copyright

We respect intellectual property rights and expect users to do the same. Copyright complaints, counter-notices, and repeat-infringer rules are explained in our Copyright Policy.

10. AI Image Features

Coomerang may offer AI-assisted image generation and editing. These features use OpenAI technology and require prompts, source images, generated images, and technical metadata to be processed by OpenAI and by Coomerang.

• You are responsible for the prompts, images, and instructions you provide.
• You must not use AI features to create illegal content, non-consensual intimate imagery, sexual content involving minors or age-ambiguous characters, infringing content, impersonation, or other prohibited material.
• AI outputs may be inaccurate, unsuitable, or similar to existing content. You are responsible for reviewing outputs before using or publishing them.
• We may block prompts, refuse generation, remove generated content, deduct or refund credits, or suspend access to AI features where needed for safety, abuse prevention, legal compliance, or technical reasons.
• We do not use your generated comics to train our own models without your explicit consent.

11. Subscriptions, Billing, and AI Credits

Paid subscriptions are processed by Stripe. Subscription plans, prices, currencies, billing intervals, included features, and AI credit grants are shown before checkout or in the account billing flow.

• Subscriptions renew automatically unless cancelled through the billing portal or another supported cancellation method.
• Cancellation normally takes effect at the end of the current paid period unless otherwise stated in the billing flow or required by law.
• AI credits have no cash value, are not transferable, and may be granted, consumed, adjusted, or expire according to the plan and feature rules shown in the product.
• If an AI image request fails due to a system or provider error after credits are reserved, we may automatically refund the reserved credits.
• Refund rights are subject to applicable consumer law and the terms shown at checkout. Nothing in these Terms limits non-waivable statutory rights.

12. Acceptable Use and Security

• Do not scrape, crawl, harvest, or bulk-download content except where expressly allowed.
• Do not probe, scan, test, attack, overload, bypass, or interfere with our systems without written permission.
• Do not upload malware, spam, deceptive content, or material designed to disrupt the service.
• Do not manipulate likes, views, reports, subscriptions, credits, or moderation systems.
• Do not use Coomerang in a way that violates applicable law or third-party rights.

13. Privacy

Our Privacy Policy explains what personal data we collect, how we use it, who we share it with, retention periods, and your rights. Our Cookies Policy explains our use of cookies, localStorage, and similar technologies.

14. Account Closure and Termination

You may stop using Coomerang at any time and may request account closure or deletion through support. Some self-service deletion features may not be available in the product at all times.

We may suspend, restrict, or terminate accounts where needed for Terms violations, legal risk, safety, repeated infringement, payment issues, prolonged inactivity, or security concerns. Severe illegal content or attempts to harm users may lead to immediate termination.

Sections relating to user content licences, intellectual property, payments, privacy, disclaimers, liability, indemnity, governing law, and any terms that by their nature should survive will survive termination.

15. Third-Party Services

Coomerang relies on third-party providers for services such as hosting, storage, content delivery, payments, age verification, email, authentication, AI processing, moderation, and geolocation/currency estimation. Their own terms and privacy notices may apply when you interact with them.

16. Disclaimers

Coomerang is provided "as is" and "as available". To the maximum extent permitted by law, we do not promise that the service will be uninterrupted, error-free, secure, available in every location, or that content will always be preserved.

We do not guarantee that moderation tools, age assurance, AI tools, search, recommendations, or safety filters will detect every issue or avoid every false positive.

17. Limitation of Liability

To the maximum extent permitted by law, Coomerang LTD will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for all claims in any 12-month period is limited to the greater of the amount you paid us for the service in that period or £25. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, death, personal injury caused by negligence, or mandatory consumer rights.

18. Indemnity

To the extent permitted by law, you agree to indemnify Coomerang LTD and its directors, officers, employees, contractors, and service providers against claims, losses, liabilities, damages, costs, and expenses arising from your User Content, your use of the service, your breach of these Terms, or your violation of law or third-party rights.

19. Changes

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, use reasonable efforts to provide additional notice such as an in-product notice or email. Urgent legal, safety, or security changes may take effect immediately.

20. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring proceedings in your country of residence or benefit from mandatory local protections.

21. General

If any part of these Terms is found invalid or unenforceable, the remaining parts continue to apply. Our failure to enforce a provision is not a waiver. These Terms, together with the policies linked above, form the agreement between you and Coomerang for use of the service.
